KPop Demon Hunters: Netflix Being Sued by Christian Metal Band Over Movie, Here’s Why

Netflix is facing legal action from a Christian metal band over its blockbuster animated movie, KPop Demon Hunters. The lawsuit alleges that the movie infringes upon the band’s trademark, among several other claims.

Christian metal band Demon Hunter was formed in 2000 by brothers Don Clark and Ryan Clark. They have filed a lawsuit against Netflix and AEG Presents, through its corporate entity, Hyde Lane.

The band has registered the “Demon Hunter” trademark in several categories. They have alleged that the title of the streamer’s mega-hit movie, KPop Demon Hunters, infringes on the trademark.

The lawsuit also cites unfair competition, alleging that KPop Demon Hunters has caused “a substantial likelihood of confusion” and an “existential crisis” for the band. To explain further, they cited an email received from a man in February who demanded a refund after spending $500 on tickets to one of their show for his children, mistaking the band for the Netflix movie due to their similar names.

The metal band further claimed that it has become difficult for them to sell their merchandise online because search results prioritize KPop Demon Hunters.

According to Hyde Lane, the term “KPop” is too generic, so including it before “Demon Hunters” does not “overcome the likelihood of confusion.” They added, “Simply put, Netflix is no more entitled to use the mark ‘KPop Demon Hunters’ than it would be to launch a recording artist, live touring show and merchandise under the marks ‘KPop Metallica,’ ‘KPop U2,’ or ‘KPop Black Sabbath.”

What did Netflix say about the KPop Demon Hunters lawsuit?

In response to the lawsuit, a Netflix spokesperson has issued a statement. “These allegations are without merit,” they declared. “Netflix has created an Academy Award-winning global phenomenon with ‘KPop Demon Hunters’ that has inspired fans around the world with its powerful music, storytelling, and characters. We look forward to vigorously defending this matter (via Variety).”

The band Demon Hunter has requested a jury trial. Further updates regarding the lawsuit are awaited.
